1. Acceptance of Terms

By downloading, installing, or using the Setshot mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Beyond Soft Ltd ("we", "our", or "us"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Description of the App

Setshot is a mobile fitness application, available on iOS and Android, that uses artificial intelligence and your device camera to automatically count exercise repetitions (push-ups, pull-ups, squats, sit-ups), record workout videos, track statistics, and provide fitness challenges.

On iOS, the App uses Apple's Vision Framework for on-device AI pose detection. On Android, the App uses Google ML Kit for on-device AI pose detection. All processing occurs locally on your device — no camera data is sent to any server.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will use the App only for lawful purposes

4. Health and Safety Disclaimer

• Consult a physician or qualified healthcare professional before beginning any exercise program
• Stop exercising immediately if you experience pain, dizziness, shortness of breath, or any discomfort
• The App's rep counting is based on AI pose detection and may not be 100% accurate
• Do not rely solely on the App for measuring physical performance in medical or clinical contexts

By using the App, you acknowledge that exercise involves inherent risks and that you assume full responsibility for your physical well-being. We are not liable for any injuries, health issues, or damages arising from your use of the App or participation in any exercise.

5. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal mobile device(s) solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written consent
• Remove or alter any proprietary notices or labels on the App
• Use the App in any way that violates applicable laws or regulations

6. Subscription and Payments

6.1 Free Tier

The App offers a free tier with limited functionality, including the ability to export videos up to 10 seconds in duration with a watermark.

6.2 Premium Subscription

Setshot Premium is available as a monthly or yearly auto-renewing subscription, offering:

• Unlimited video export duration
• No watermark on exported videos
• HD quality export

6.3 Billing

All payments are processed through Apple's App Store (iOS) or Google Play (Android). Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID Account Settings (iOS) or Google Play Account Settings (Android).

6.4 Refunds

All purchases are final and non-refundable except as required by applicable law or the applicable platform's refund policies. Refund requests must be submitted directly to Apple through the App Store (iOS) or to Google through Google Play (Android).

7. User Content

The App allows you to record and save workout videos. You retain all rights to your video content. By using the App, you grant us no rights to your video content.

8. Camera and Microphone Access

The App requires access to your device's camera and microphone to function. You can revoke these permissions at any time in your device Settings, but doing so will prevent the App from functioning properly. All camera and microphone data is processed entirely on your device.

9. Intellectual Property

The App, including its design, features, content, and technology, is owned by Beyond Soft Ltd and protected by intellectual property laws. The Setshot name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Beyond Soft Ltd.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Beyond Soft Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Third-Party Services

The App integrates with Apple's services (App Store, StoreKit, Vision Framework, AVFoundation) on iOS, and Google's services (Google Play, Google Play Billing, Google ML Kit, Camera2 API) on Android. Your use of these services is subject to Apple's and Google's respective terms and conditions.

15. Updates and Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may require you to update the App to continue using it.

16. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

17. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beyond Soft Ltd with respect to the App.
